Yaz Class Action Lawsuit Moving Forward In Toronto

A lawsuit has been filed in Ontario against Bayer -the manufactures of Yaz and Yasmin

The lawsuit alleges that Canadian women were “kept in the dark” about the increased risk of blood clots, stroke, heart attack, gallbladder disease and other medical conditions they had from taking Yaz or Yasmin.

In the United States, similar cases have taken place.  In March, Bayer paid up to $24 million U.S. dollars to settle gallbladder injury claims in Illinois, California, New Jersey and Pennsylvania.  According to Reuters, plaintiffs who suffered gallbladder injuries would receive $2,000 while those who had their gallbladders removed would receive $3,000.  A total of $1 Billion U.S. dollars will be divided among 4,800 women who said the pill caused blood clots that resulted in heart attack, strokes and other injuries.

However, in the United States, these cases are ultimately consolidated.  ”In the U.S., most class actions never go to trial and instead if a class is successfully certified that it’s allowed to go forward as a class action, the defendant settles.” said Glenn Cohen, a Harvard law school professor.

In April 2012, the FDA (Food and Drug Administration) required Bayer to change the labels on Yaz and Yasmin birth control products to emphasize blood clot warnings.

Non-FDA-approved Marketing of Yasmin

Virtually all prescription medicine introduces a risk of side effects. The common contraceptive, Yaz is no exception. Some women may experience none of the side effects; some will tolerate minor issues such as headache, and weight gain. And some will suffer the worst and most extreme side effects such as blot clots or chest pain.
Common Side Effects of Yaz
Before receiving FDA approval, Yaz, like all prescribed drugs, underwent clinical trials. These studies revealed common side effects that occur in more than one percent of the women and are fairly easy to treat by healthcare providers.

Yaz News | Yaz Side Effects 2013

A Yaz side effect lawsuit was filed in the Superior Court of the State of California, San Francisco, on March 19, 2013.

The plaintiffs include five women who claim to have suffered from DVT (Deep Vein Thrombosis), and other injuries arising from the use of Yaz.

According to court documents, the women contest that Bayer HealthCare Pharmaceuticals – the manufacturer of Yaz, should have known its Yaz birth control product could cause DVT, and that it was a high-risk drug.

Based on presently available information on Yasmin, DRSP-containing COCs may be associated with a higher risk of venous thromboembolism (VTE) than COCs containing the progestin levonorgestrel or some other progestins…

Women taking or who have taken birth control pills that contain Drospirenone have a sevenfold risk of developing blood clots compared to women who take birth control pills that contain levonorgestrel (a synthetic progestogen).

On April 11 2012, the FDA ordered Bayer to provide stronger and more clear warnings on their packaging labels of Yaz and Yasmin blood-clot dangers.

Today, there are more than 13,000 pending Yaz lawsuits, yet Yaz, Yasmin and Ocella remain some of Bayer’s highest-selling pharmaceuticals.

FDA Updates Information For Women Taking Yaz

FDA (Food and Drug Administration) safety review update on the possible increased risk of blood clots with birth control pills containing drospirenone:

“The U.S. Food and Drug Administration (FDA) has completed its review of recent observational (epidemiologic) studies regarding the risk of blood clots in women taking drospirenone-containing birth control pills. Drospirenone is a synthetic version of the female hormone, progesterone, also referred to as a progestin.  Based on this review, FDA has concluded that drospirenone-containing birth control pills may be associated with a higher risk for blood clots than other progestin-containing pills. FDA is adding information about the studies to the labels of drospirenone-containing birth control pills.”

The drug labels (BeyazSafyralYasmin and Yaz) will now report that some epidemiologic studies reported as high as a three-fold increase in the risk of blood clots for drospirenone-containing birth control pills when compared to birth control pills containing levonorgestrel or some other progestins, whereas other epidemiological studies found no additional risk of blood clots with drospirenone-containing products.

Yaz Warning Letter

In a warning letter from the Department Of Health & Human Services

“The Division of Drug Marketing, Advertising, and Communications (DDMAC) has reviewed two 60-second direct-to-consumer (DTC) broadcast television advertisements (TV Ads) entitled “Not Gonna Take it” and “Balloons” for YAZ Tablets submitted by Bayer HealthCare Pharmaceuticals, Inc. under cover of separate Forms.  The TV Ads are misleading because they broaden the drug’s indication, overstate the efficacy of YAZ, and minimize serious risks associated with the use of the drug.  Thus, the TV Ads misbrand the drug in violation of the Federal Food, Drug, and Cosmetic Act (the Act), and FDA’s implementing regulations.  These violations are concerning from a public health perspective because they encourage use of YAZ in circumstances other than those in which the drug has been approved, over-promise the benefits and minimize the risks associated with YAZ.”

The warning letter proceeds to state:

“Additionally, there are numerous warnings associated with the use of YAZ including, but not limited to, venous and arterial thrombotic and thromboembolic events (such as myocardial infraction, thromboembolism, stroke), hepatic neoplasia, gallbladder disease, and hypertension.  Moreover, YAZ has additional risks because it contains the progestin, drospirenone.  Drospirenone has antimineralocorticoid properties which can lead to hyperkalemia in high risk patients, which may result in potentially serious heart and health problems.  Women taking YAZ must be concerned about the drug interactions that could increase potassium, in addition to the drug interactions common to all combination oral contraceptives.”

Yaz and Yasmin remain among Bayer’s top selling pharmaceuticals despite the over 13,000 pending Yaz & Yasmin lawsuits.

According to the Bayer HealthCare Press Center:

The Bayer Group remains on a path of growth. “The upward trend in our life science businesses – HealthCare and CropScience – continued in the third quarter of 2012,” Management Board Chairman Dr. Marijn Dekkers said Tuesday following the publication of the interim report. HealthCare, particularly the Pharmaceuticals business, gained further growth momentum.

Sales of the Bayer Group advanced by 11.5 percent in the third quarter. The currency- and portfolio-adjusted (Fx & portfolio adj.) increase was 5.5 percent. Earnings before interest and taxes (EBIT) fell by 23.7 percent to EUR 838 million. Net special items totaled minus EUR 356 million. Included here were EUR 205 million in further accounting measures taken – mainly based on additional claims asserted but not filed in court – for all cases in connection with the oral contraceptive Yasmin™/YAZ™ of which Bayer is currently aware and which the company considers to be worthy of settlement (venous clot injuries). Among the other special charges were EUR 134 million in restructuring expenses.
